User Agreement

Welcome to our shop (the "Shop"), which is accessible via the Candlebloom Arts website located at www.com (the “website”). These terms of use (the "User Agreement") govern the relationship between you as a user of the Marketplace ("User", "you", and "your", as the context requires) and Candlebloom Arts (“Candlebloom Arts”, “we”, “us”, and “our” as the context requires). Users of the Shop include customers and potential customers ("Buyers").

You agree to be bound by the terms of this User Agreement whenever you use the Shop, register an account on the Shop, log into the Shop or place an order on the Shop, so it is important that you carefully read and agree to all the terms in this User Agreement. If you do not agree with the terms of this User Agreement, or any of our other policies you may not use the Shop or any of the Candlebloom Arts Services.

General Information

The Shop is only available to, and may only be used by, adults who can form legally binding contracts under applicable law. This means that you must be at least 18 years old to use the Shop. Minors are not permitted to use the Marketplace under any circumstances unless properly supervised by their parent or legal guardian.

We accept no liability for any failure to comply with this User Agreement where such failure is due to circumstances beyond our reasonable control. If we waive any rights available to us under this User Agreement on one occasion, this does not mean that those rights will automatically be waived on any other occasion. If any of the terms of this User Agreement are held to be invalid, unenforceable or illegal for any reason, the remaining terms and conditions shall nevertheless continue in full force and effect.

We may amend the terms of this User Agreement and our policies from time to time in our sole discretion. We will make reasonable efforts to notify you of material changes either by sending you an email to the email address you have registered with Candlebloom Arts and/or by displaying on our Shop information about modifications to this User Agreement. Either way, your continued use of the Shop will constitute ongoing agreement to the terms in this User Agreement as updated from time to time.

The Candlebloom Arts Services may contain translations powered by Google LLC. Google disclaims all warranties related to the translations, express or implied, including any warranties of accuracy, reliability, and any implied warranties of merchantability, fitness for a particular purpose and noninfringement.

Account Management

When creating an account, you must provide a username, your email address and a password. Only a single natural person may be the owner of an account. When registering, you must provide the required data completely and truthfully.

To help us verify your identity and to protect the security of your account and to comply with the law, you may be requested to provide current and accurate information about yourself such as your name, physical address and telephone number.

Passwords

You are responsible for actions made on the Shop using your account, including any Products purchased, even if these actions were not approved or contemplated by you. You are solely responsible for any loss caused by any use of your password by you or any other person.

You agree that you will not disclose your password to any other person and you will not keep your password where it can be copied or used by anyone other than you. If you suspect someone else knows your password, you must change it immediately.

In the event that you can no longer access your account and request our assistance in remedying the situation, we may, to the extent permitted by law, request information about your identity in order to ensure that you are the owner of the user account in question. This serves in particular to ensure the security of user accounts and to prevent third parties from gaining unlawful access to user accounts.

Privacy Policy

Your privacy is very important to us. Users should refer to our Privacy Policy, which is incorporated into this User Agreement by reference, for information about how we collect and use personal information. When you use the Shop and our Services, you may grant certain permissions to us for your device. Most devices, such as mobile devices, provide you with information about these permissions. Although we take all reasonable measures to protect Users, you must also take precautions to ensure that the process by which you access our Shop and use our Services does not expose you to the risk of viruses, computer malware or other harm to your computer system.

Electronic Communications

When you use the Shop, or send emails via the provided contact email, you will be communicating with us electronically. You consent to receive communications from us electronically, such as emails or notices and messages on the website, and you can retain copies of these communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. You also agree that your electronic agreement is the same as your signature on paper.

Terminating and Restricting Accounts

Access to the Shop may be limited or terminated at any time by us without notice for any reason in our sole discretion.

Permanently blocked Users may not use the Candlebloom Arts Services through another existing or newly registered account. You may terminate your account at any time by logging into your account, clicking on the "Delete Account" link and then following the instructions.

Purchasing a Product on the Shop

Buyers can purchase products in the Shop by using a valid credit card or a third-party payment processor. You do not have to be a User to purchase a product. The retail price you pay is determined by the Seller and is fixed at the time of ordering.

Buyers may not cancel an order once it has been submitted. It is your responsibility as the customer to ensure your Product delivery address is correct. Candlebloom Arts take no responsibility for any Product you do not receive – or receive late – in connection with the delivery address you provide to the Marketplace including, but not limited to, errors in the address you provide.

Delivery

Delivery of Products will be facilitated pursuant to your instructions by postal or courier service and will be paid for by you at the amount that is indicated at the time of purchase. Shipping charges will be applied to the order, which will vary depending upon multiple factors, like location and the size and price of the product.

Damaged Products and Returns

If a Product is delivered to you, but it is damaged in some way, the applicable third parties who participated in the Product manufacturing will be notified, so that they may issue a Product replacement. As a condition to receiving any remedy for a damaged Product, you may be required to submit reasonable proof of such damage in the form of a photo of the damaged Product or the return of the damaged Product itself to the Shop. You will bear any cost of returning such Product. If you receive a damaged Product, then you must email customer service within seven (7) days of receipt to report the nature of the damage and to request a new product to be sent to you at no cost to you.

Before you order a Product, you, as the Customer, are responsible for verifying it is the Product you want including, but not limited to, the quality of the Content, the image printed on the Product, misspelled words, grammatical errors, formatting, overall design and appearance, source or origin of goods, affiliation, or overall appearance. Severability

If any clause within this Arbitration Agreement (other than the Class Action Waiver clause set forth in paragraph D above) is found to be unenforceable, that clause will be severed from this Arbitration Agreement and the remainder of this Arbitration Agreement will remain in full force and effect.
